Terms of Service

1. Acceptance of terms
By accessing or using Only Upscalers (the “Service”), operated by Scientia AI Private Limited (CIN U62091GJ2024PTC150774), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. The service
Only Upscalers provides AI-powered image upscaling: Creative Upscale, Ultra Upscale 8X, and Unblur & Restore. Output quality and maximum resolution depend on the upscaler you choose and the settings you apply.
3. Accounts
You need an account to use the Service. You are responsible for keeping your sign-in credentials secure and for all activity under your account. You must be able to form a binding contract to register.
4. Credits and billing
Upscales are metered in credits. A credit is reserved when a run starts, and how many a run costs scales with the output size you request — the cost is shown before you run it. New accounts receive a small number of trial operations, which produce watermarked output and carry no charge. Beyond those, the Service requires a paid plan or a credit top-up. Payments are processed by our payment partner; we do not store your card details.
5. Failed runs
If an upscale fails, the credit reserved for it is returned to your balance automatically — you do not need to ask. Credits consumed by runs that completed are not returned on the basis that you did not like the result; the crop preview is there to let you judge settings before spending a credit on a full run. Previews cost no credit, but they are not unlimited — each plan includes a monthly allowance of crop previews, shown on the pricing page.
6. Cancellation and refunds
You can cancel a plan at any time. What happens to money already paid, and when a refund is available, is set out in full in our Refund & Cancellation Policy.
7. Your content
You retain all rights to the images you upload. You are responsible for ensuring you have the rights to any image you submit. You grant us a limited licence to process your images solely to deliver the Service. We do not use your images to train models.
8. Acceptable use
You may not use the Service to generate content that infringes the intellectual-property rights of others, that is unlawful, or that depicts a real person without their consent. We may suspend accounts that violate these terms.
9. Output & warranties
We work to produce high-quality upscaled output, but you are responsible for reviewing any file before relying on it. Upscaling reconstructs detail that was not in the source image, so output should not be treated as an accurate record of the original subject. The Service is provided “as is” without warranties of any kind.
10. Limitation of liability
To the maximum extent permitted by law, Scientia AI Private Limited is not liable for indirect or consequential losses arising from your use of the Service. Where liability cannot be excluded, it is limited to the amount you paid for the Service in the three months before the claim arose.
11. Governing law
These terms are governed by the laws of India, and the courts of Gujarat have exclusive jurisdiction over any dispute arising from them.
12. Changes
We may update these terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
